This Agreement outlines the terms for healthcare providers, dietitians, and wellness specialists ("Providers") using FitTrack to monitor or advise patients/clients.

1. Platform Nature

Provider acknowledges that FitTrack is a consumer health and fitness platform and is not a certified Electronic Health Record (EHR) system unless explicitly stated in a separate enterprise addendum. FitTrack facilitates data tracking but does not replace professional medical equipment.

2. Compliance Responsibilities

Provider is solely responsible for ensuring their use of FitTrack complies with all applicable laws and regulations regarding patient privacy and data security, including HIPAA (USA) and GDPR (EU), beyond the technical safeguards provided by FitTrack.

3. Patient Consent

Provider must obtain all necessary consents from patients before onboarding them to the FitTrack platform or accessing their health data through the Provider portal.

4. No Medical Advice by Platform

FitTrack does not provide medical advice. Any insights generated by the platform are for informational purposes. Provider retains full responsibility for all diagnosis and treatment decisions.

Professional Liability

Provider agrees to maintain appropriate professional liability insurance and indemnifies FitTrack against any malpractice claims arising from their use of the platform.
